SERVICE OF WATER SUPPLY PIPES

 Upon request of the lot owner, blockage of a water supply pipe causing extremely low water pressure at an individual lot shall be serviced as follows:

A.         The contractor hired by the Association shall dig to curb stop valve and determine whether there is blockage between the curb stop valve and the main.  If so, the blockage shall be removed at the expense of the Association.

B.         If, after service of the common system, the contractor determines that additional blockage exists in the household system, the lot owner may elect to have the Association’s contractor service the household system, and if so elected, the lot owner shall reimburse the Association for the cost of that portion of the contractor’s charges which is attributable to work done on the household system.

C.         If the contractor determines that no blockage exists in the common system, but that the blockage is solely within the household system, the lot owner shall reimburse the Association for the entire charge to it by its contractor for all excavation and inspection done on that lot.

D.         Extra charges incurred by the Association to service the common system within a lot may be charged to the lot owner if caused by landscaping, sidewalks or other conditions of the lot which require special excavation techniques.  The Board of Directors shall first determine, on a case by case basis and in consultation with the lot owner, the factors supporting the reasonableness of such a charge.

IT IS FURTHER RESOLVED that the foregoing statement of policy be printed in the Directory of the association.

THE FOREGOING RESOLUTIONS WERE ADOPTED BY THE BOARD OF DIRECTORS OF THE FRANKLIN KNOLLS HOMEOWNERS ASSOCIATION ON SEPTEMBER 19, 1984,  A COPY WAS DELIVERED TO ALL USERS OF THE WATER SUPPLY SYSTEM ON OCTOBER 20, 1984, AND AN OPEN MEETING OF USERS FOR THE PURPOSES OF QUESTIONS AND COMMENTS WAS HELD ON OCTOBER 24, 1984.
